If it comes down to it, I fully expect his legal team to try and appeal a jail sentence on the grounds that he is not mentally competent to understand the charges against him.
That would be a “when all else fails” defense. Age alone wouldn’t be enough. He’d have to be examined by a panel of psychiatrists and other mental health professionals and would require MRI/PET/CT scans and other medical evidence to at least arrive at a “more likely than not” degree of mental incapacity to justify the claim.

@DocSavage The only way it would happen (unless ordered by a court) would be a defense when all other options failed strictly to keep him out of prison.
