NJ Gym Owner Who Defied Covid Shutdown Thanks Supporters, Insults Governor After He’s Cleared Of 80+ Charges

A New Jersey gym owner who openly defied Covid-19 restrictions imposed by the Garden State was acquitted of over 80 charges stemming from various confrontations with law enforcement during the pandemic.

He took to social media with a defiant response to express his sentiments towards the state governor who could “suck his d–k.”

Ian Smith and Frank Trumbetti, the co-owners of Atilis Gym located in Bellmawr, found themselves at odds with authorities in May 2020 when they chose to keep their fitness facility operational despite Governor Phil Murphy’s directive to shutter non-essential businesses.

Smith particularly made headlines throughout the ordeal, appearing on various broadcasts like Fox News to denounce Murphy’s directive and proclaim that he would not comply with them.

He was eventually sentenced to one year probation, notably dubbing it an “absolute joke,” Fox previously reported.

The debacle didn’t stop there, however, as law enforcement actions escalated quickly.

One episode included the arrest of gym patrons as they exited the premises.

The owners also faced numerous summonses and were ultimately fined approximately $165,000 for flouting public health emergency regulations, as reported by NJ.com.

Among the charges were violations of gubernatorial orders, operating without the required mercantile license, creating a public nuisance, and disturbing the peace.

John McCann, the two gym owners’ attorney based in Oakland, New Jersey, revealed that some of these charges carried the possibility of a six-month jail sentence for the duo.

All that has changed though thanks to a recent development late last month where a municipal judge in Winslow Township dropped charges against the individuals involved in the prolonged legal dispute, as reported by McCann to the outlet.

“It was a just decision,” McCann asserted to The New York Post on Tuesday, contending that the charges brought by local authorities were unfounded. “[The town] was not acting in good faith.”

Smith celebrated his legal triumph on Instagram.

He expressed gratitude to his supporters and directed insults toward the governor. “This victory opens the battlefield again and gives us options to continue to push back and bring justice to the treasonous actions of Phil Murphy and his lackies,” Smith proclaimed.

McCann disclosed that neither local nor state officials opted to challenge the ruling. “When you look at this, it didn’t make a lot of sense at the time,” he remarked to NJ.com.

“It kind of looked like they were throwing everything they could at these guys … these charges hung over these guys’ heads for over four years,” he continued.

The legal battle against two individuals was intense, with accusations flying and charges looming for over four years. However, cooperation from Bellmawr regarding the legal process was minimal.
