Congress has the sole power to pardon insurrectionists. The person first has to be tried and convicted in a federal court. The person's conviction can be appealed to a higher court but the court can not restore the person's right to hold office. That belongs solely to Congress.

Evidently, the Justice Department bigwigs took bribes not to prosecute the orange traitor. If they had had any integrity they would have convened a federal grand jury to get an indictment but they didn't. So, they are either corrupt or incompetent, maybe both.
