House Democrats Move To Bar Trump From Office

The bill, introduced Thursday by Rep. David Cicilline (D-RI), aims to use Section 3 of the Fourteenth Amendment to get the job done, accusing Trump of orchestrating an insurrection with the Capitol riot on January 6, 2021, which briefly disrupted the certification of President Joe Biden’s 2020 election victory.

14th Amendment, section 3:

"No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability."

"...shall have engaged in insurrection..."

As determined by whom? The Amendment doesn't say, although curiously, it provides a means of "removing such disability."

I would presume that the framers of this amendment meant as determined by a court of law, not by some "select" Congressional committee.
@Thinkerbell lol. It probably wouldn't have passed with that clarification, tbh.
