When I was 6 years old, I parked my brand new tricycle that Santa brought me next to the garbage cans on garbage day. I watched the garbage truck crush my bike like play-dough. I was so traumatized, I couldn't speak to register an objection.

You can sue, and maybe you will win, but the trauma of losing that bike will stay with your son forever.

Was the bike in a public area like the street? Then you may not sue (well, you can but you'll lose); the burden is on your to mitigate your risks. However, if the truck was on your property at the time, then yes, there's a case.

That said, you might was to first try contacting the company, explaining and asking for some recompense. Sugar versus vinegar, you know?
