@kodiac Because the existing law was discriminatory - it dealt differently with straight people than it did with gays.

California doesn't have a romeo and Juliet clause - so a senior having sex with a sophomore is a felony. When it's hetero sex, it's a felony but the judge can decide whether the offender goes on the registry for life or not. When it's homo sex, the registration is mandatory. This new law makes the state treat homos like it treats the hets, leaving the registration up to the judge.

None of this applies to sex with 10 year olds, registration is mandatory in those circumstances, and this law doesn't change it. It come into play when the victim is 14+, the sex was consensual, and the age gap is not too large. And the judge can still put them on the registry anyway.
