Well they certainly have rights. I honestly believe they have a right not to be abused and not to be imprisoned for an inordinate amount of time without a trial. They have basic human rights. I don't believe they have the same rights as lawful residents or citizens though I don't know how anyone could argue otherwise.

@MrBrownstone perhaps you need to brush up on your star trek knowledge. Even in that fictional universe immigrants had basic human rights. Many times immigrants where taken care of while being allowed to petition. Even offers to find compatible worlds where made before even petitioning.
