Do you believe a homeowner should be charged for murder if he or she uses lethal force on a home invader.

There have been cases where the family of a perpetrator will demand legal action against someone who injured or killed their family member who broke into the home in the first place.

Do think this makes any sense?

The tough cases, even in states with shoot the burglar laws are where burglars get shot in the back or out in the yard trying to escape the homeowner.

@sunsporter1649 that's one problem. The other is when homeowners shoot kids.

I'm not a big fan of shoot the burglar laws myself. I just could never get my head around killing in defense of property, and it seems to me like if it's not self defense, it shouldn't be excused just because the victim was a trespasser.

@sunsporter1649 I get it, and it seems like it's most often a scared old man shooting at a 12 year old kid who looked much bigger and scarier when he was alive.


I've actually got a piece of a civil case right now where a homeowner fired 41 "warning shots" at a utility guy in his driveway.. Nobody got hurt, but he mouthed off to the cops who arrested him, and now he's suing the utility company and the sheriff's department pro se for intentional infliction of emotional distress.
