Trump Campaign and Russia. Were These Laws Broken?

This is where I believe the Trump campaign tripped up. Trump went on and on during the campaign about what a great dealer maker he is. And he probably does believe that he can get a great "deal" with Russia over whatever. But the LAW says one can NOT talk to a foreign power or its officials "with intent to influence the ... conduct of any foreign government ... in relation to any disputes or controversies with the United States" without permission from the United States government.

So if Trump or his campaign officials met with Russians anytime before noon ET, January 20, 2017, for the purposes of influencing Russia's relations with the U.S. over disputes with Syria, Iran, North Korea, Ukraine, etc. - and did NOT have permission from the Obama administration, it would have been ILLEGAL.



18 U.S. Code § 953 - Private correspondence with foreign governments

Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.

This section shall not abridge the right of a citizen to apply, himself or his agent, to any foreign government or the agents thereof for redress of any injury which he may have sustained from such government or any of its agents or subjects.

But I think Robert Mueller is going for something bigger than that, hoping to find a quid pro quo involving the Russians while violating 18 U.S. Code § 371 after already having violated 18 U.S. Code § 953.


18 U.S. Code § 371 - Conspiracy to commit offense or to defraud United States

If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both.

If, however, the offense, the commission of which is the object of the conspiracy, is a misdemeanor only, the punishment for such conspiracy shall not exceed the maximum punishment provided for such misdemeanor.

Great stuff. With all of the known Russian contacts with the trump campaign, it is almost certain that there were illegal activities. The only questions remaining are how extensive the illegal activities were, and if they involved trump himself. We'll find out when Mueller completes his investigation.

Is the first one the Logan Act? Republicans said it's been ignored since 1789 and no one has ever been prosecuted since before Trump was even in office. But we never had a President like this.

As for the second, I think the against the US thing is a problem, since he thinks he is the only arbiter of that, and Fox is still spreading his propaganda.

Can you imagine what the jury voir dire would be like?

@MistyCee Yes, it is. First passed in 1799, wording of the law is essentially the same today. High time someone is prosecuted for it.

As to 18 U.S. Code § 371 I'm sure, though it may take a while, a jury can be seated. Just think of how many people didn't vote.
