The Israelis routinely detain kids without charge or trial and sentence them to 20 years for throwing a rock.

The only difference is when you have the privilege of a state you can create a legal fiction to justify it.


And that is in practice the only difference. Kidnapping becomes "detention" or "arrest" when you have a state and can make laws to justify your actions.

But in terms of the actions it is the same thing.
