Does this sound legal?

I’m not originally from the USA, so American labor laws are a bit strange to me. There is a lot I know you guys don’t protect against.

This is what happened to my coworker not me.

She needed today off, and our boss threatened her and said that she either comes in today or she can hand in her resignation.

That sounds like a way of forcing someone to quit instead of just firing them. Which sounds scummy.

I am curious about what would have happened if she said she’s not coming in and she’s not handing in her resignation,

I guess we’ll find out if that ever happens to me.

Why didn't she just call out sick? That's how you handle bosses like that.

It does sound like the employer is trying to get her to quit.

Not knowing the type of business…or anything about her..(not asking)…it’s difficult to say..
As you have described it...... I believe it is legal for him to say that. Yet, if he follows through with his threat, he will need to find and hire another person.

My question would be... aren't there enough people working there to cover if someone has a death in the family or gets ill??? <---- These are the things a good boss will be thinking about (and having solutions for)....

OTOH, A "Bad Boss" ... off on his/her own little power trip will always be using any situation to make him/herself look to others as if they have "power."
@Threepio but isn’t that just firing? It seems like she’s twisting words to make it looks like she quit when she hadn’t.

She better not fire her. We only have 5 employees and I’m not working any more hours than I already do if we go down to 4 people 😤 she will have 3!

Have her talk to HR about it.
Depends which state and how big the company is. What happens next may also affect any unemployment benefits but yes. It is something they may be able to do.
@aboveaverageaveragejoe isn’t forcing a resignation just firing? They should just say that, because to me it looks like they’re also trying to prevent this person from receiving benefits.

Also, this person wanted off because her uncle just died. To me that’s a plausible reason to not come into work.
