What are your thoughts on that track meet stabbing case out of Frisco, Texas?

What happened? Apparently during a rain delay at a track meet, this kid Karmelo Anthony went and sat under another team's tent. He was then confronted by the victim (Austin Metcalf). The victim told Karmelo to leave, he said "make me". Apparently after that it turned into an altercation where Karmelo reached into his bag and said "touch me again, and see what happens". He then stabbed the victim in the chest with a pocket knife, fled the scene and tried to toss the knife. Austin died of his injuries.

What I think the verdict will be: To me it looks like 2nd degree murder. Remember the difference between 2nd degree murder and manslaughter is the intent to kill. You could argue that one could not reasonably believe that a common pocket knife would be sufficient to kill someone and that the defendant didn't actually intend to kill the victim. I could see the jury going that direction. However, it seems odd to me that the defendant stabbed the victim in the chest. This looks like there was an intent to kill. It seems more reasonable to me that if a knife was used in an act of self defense, that the defendant would have slashed at the victim or stabbed him randomly. I perceive stabbing the victim in the chest as a very deliberate act, and shows an intent to kill. Realistically, though, I see the jury convicting on the manslaughter charge. I just don't see them thinking beyond a reasonable doubt that a 17 year old deliberately stabbed someone in the chest with an intent to kill. What are your thoughts?

Charge: The jury found him guilty of murder, rejecting the defense's claim of self-defense.

Sentencing Option: During the sentencing phase, the jury had the option to find that Anthony acted under the influence of "sudden passion," which would have reduced the offense to a second-degree felony (carrying a sentence of 2 to 20 years).

Jury Decision: The jury rejected the "sudden passion" mitigation.

Sentence: As a result, Anthony was sentenced to 35 years in prison. Under Texas law, a standard murder conviction carries a range of 5 to 99 years or life in prison.

That's first degree murder

What is the average of gang members? You had a 14 yr old shoot someone the other day of course a 17 yr old can have intent. We carried knives and had guns in our cars we never thought to use them in fights. Some states want national voting age 16 if thats the case for charging him as an adult.

Well school rulles a kinfe is not allowed for that reason. He had intent just by bring the knife but i agree with second degree also

@dale74 Yeah because in order for it to be first degree, he would have had to have planned out that he was going to murder someone. I don't think that's what happened.

In Texas there’s no 1st, 2nd, 3rd degrees of Murder. There is just Capital Murder (death penalty or life w/o parole), Murder (5-99 years or life with the possibility of parole), Manslaughter (2-20 years) and Criminally Negligent Homicide (2-10).

The kid was charged with Murder and rightly found guilty. Now we wait for the sentence.

I think the verdict was accurate. I think sometimes hot-headed guys get angry enough that they want to kill someone who pissed them off. Well, you don't have a right to kill someone who pissed you off, so you get to go to prison instead. Self-defense did not seem believable to me. Now one teenager is dead, and the other threw his life away, all over a trivial argument. Never should've happened in the first place.

@MrSmooTh it wasn't premeditated so they wont execute him, even though he deserves it. Life in TDC is no picnic . I hope the victims family can heal now
