If they entered the country illegally they have committed a crime. If they are going to a courthouse to appear before a judge that means they have committed a crime since they’ve been here illegally. So yes I wholeheartedly approve of this tactic.

That's the problem. It hasn't been established that they entered the country illegally and committed a crime before they are being deported. How would you like it if you woke up in jail tomorrow and you're told you're on death row because you committed a murder in a state you've never even visited???
No, you can't appeal this decision because they have taken away your right to a fair trial. You're just there until the order for your execution comes in.
See... without a trial, they cannot establish that you really are the bad guy - and that's important when you have thousands of people who share a name (because your name isn't as unique as you think it is... less so if you have a common last name like Smith or Singh).
Without a trial, it also cannot be determined if the country is right in its decision to deport you. Unless ICE are standing at the border and literally see them enter the location illegally, they are innocent until proven guilty and you need a trial to establish that they have committed the crime they're accused of.

@HootyTheNightOwl 8 US Code 1325 makes it abundantly clear they have committed a crime by not entering at a designated point of entry. Swimming across the Rio Grande, being boated by coyotes, etc is a crime. And it comes with a fine and prison sentence or deportation.
@KateATX The Constitution still says that they are entitled to a fair and just trial, regardless of how they came to be present in the state they were found in.
You can't walk down the street imposing fines, prison sentences and deportations like they are candy - because, sooner or later, you're going to find that the person you're deporting is someone you have a duty to protect.

How do you prove that they aren't born or naturalised in the United States - when, evidently, no one is checking up on their status or right to reside in the US??? Remember Kilmar Armando Abrego García??? That's right... the Kilmar Armando Abrego García, who was granted "Withholding of removal" status in court in 2019 due to gang threats faced by him and his family in El Salvador.
What happened to him??? Oh yeah, that's right... he was deported on March 15, 2025, wasn't he???
Now, he was obviously engaging with the system enough that they knew who he was enough to show up to deport him... but they didn't know who he was enough to check his details in the system and make sure he was safe enough to deport. Surely, he wouldn't have been granted "Withholding of removal" status if he hadn't satisfied the court that he was in sufficient danger that simply sending him back would cause serious harm or even death to him and his family???

@KateATX And, how many of his charges have been proven in court??? Zero, that's right... he is innocent until proven guilty in a court of law. Just like any of the other thousands of suspects who are sitting in jail right now.

I support a fair and just trial for EVERYONE - not just the ones that fit neatly in the box of being "legal" citizens because, everyone has the right to a fair and just trial in the matter of public interest. However, even that is not infallible because innocent men and women have still been put to death for crimes that they were later found to have not committed on the basis of their DNA not being present at the crime scene.
