Those are due process rights. And everyone within our borders gets the same due process rights. Need to see what SCOTUS has ruled??

DEAD WRONG!!! Did you fail to read the decisions I posted above?? Here's more, from the current SCOTUS:
“It is well established that the Fifth Amendment entitles aliens to due process of law” in the context of removal proceedings. Reno v. Flores, 507 U. S. 292, 306 (1993). So, the detainees are entitled to notice and opportunity to be heard “appropriate to the nature of the case.” Mullane v. Central Hanover Bank & Trust Co., 339 U. S. 306, 313 (1950). More specifically, in this context, AEA detainees must receive notice after the date of this order that they are subject to removal under the Act. The notice must be afforded within a reasonable time and in such a manner as will allow them to actually seek habeas relief in the proper venue before such removal occurs.

This is called a "terry stop" and is limited to 20 minutes, at the location of the stop. Moving a person elsewhere requires probable cause and arrest.

Tell us, please, @pdockal, what law you believe gives tRump's national secret police force these powers above and beyond those granted by the Constitution. What law??

Rumeysa Ozturk, 30, a Turkish national and doctoral student at Tufts University has been detained by U.S. Department of Homeland Security agents for her pro-Palestinian advocacy.

Ozturk had just left her home in Somerville on Tuesday night when she was stopped, lawyer Mahsa Khanbabai said in a petition filed in Boston federal court. AP obtained video of the arrest and it shows Ozturk being detained by multiple masked U.S. Department of Homeland Security agents.

U.S. District Judge Indira Talwani issued an order giving the government until Friday to answer why Ozturk was being detained. Talwani also ordered that Ozturk not be moved outside the District of Massachusetts without 48 hours advance notice.

But as of Wednesday evening, the U.S. Immigration and Custom Enforcement’s online detainee locator system listed her as being held at the South Louisiana ICE Processing Center in Basile, Louisiana.

ICE officers are sworn federal law enforcement officers who operate within the confines of the law. Section 287 of the Immigration and Nationality Act provides ICE officers the authority to arrest aliens without a judicial warrant.
In fact, no judge in this country has the authority to issue a warrant for a civil immigration violation. Congress, by statute, vested this authorization solely to supervisory immigration officers.
Local police officers don’t need a warrant when they encounter someone breaking the law in a public space, and the same holds true for ICE officers.
Obstructing or otherwise interfering with an ICE arrest is a crime, and anyone involved may be subject to prosecution under federal law. In addition, encouraging others to interfere or attempt to obstruct an arrest is extremely reckless and places all parties in jeopardy.

What's really happening on the ground is that tRump's national secret police have "detained" US citizens and denied their proof of citizenship!!

Earlier this year, Jensy Machado, a Northern Virginia man who voted for Trump, was handcuffed by ICE agents. A spokesperson for ICE said Machado “matched the description of the subject of an operation.” Machado is now reconsidering his vote for the president and said ICE agents are “just following Hispanic people.”


A U.S.-born citizen who was wrestled into the dirt, handcuffed and detained in a vehicle as part of an immigration raid had a REAL ID on him that was dismissed as fake, the man's cousin said Friday.

Video of the arrest, aired by Noticias Telemundo, showed authorities grabbing Leonardo Garcia Venegas, 25, while at a job site in Foley, Alabama, on Wednesday and bending his arms behind him. Someone off-camera can be heard yelling, "He's a citizen."

Garcia told Noticias Telemundo that authorities took his ID from his wallet and told him it was fake before handcuffing him. REAL ID is the identification U.S. citizens are required by law to have in order to travel through airports and enter federal buildings. It is considered a higher security form of identification.

"Apparently a REAL ID is not valid anymore. He has a REAL ID," his cousin Shelah Venegas said. "We all made sure we have the REAL ID and went through the protocols the administration is asking for. ... He has his REAL ID and then they see him and I guess because his English isn't fluent and/or because he's brown it's fake, it's not real."

You mention "Section 287 of the Immigration and Nationality Act" but you fail to mention the ways in which it is superceded by Ronald Reagan's 1986 asylum laws. When two laws conflict, the newer law takes precedence.
