I wouldnt worry about it.. The guy will be charged with something serious that the police know full well they cant prove and everyone goes home happy. We have had a few home invasions where the homeowner was charged with murder. Clearly they were never going to prove it, so he gets off. Stressful. But all the boxes get ticked.
