Tate chose to live in Romania under Romanian laws. I expect his continued detention is legal under those laws.

He moved to Romania in 2017, saying he wanted to live in a country where “corruption is accessible for everybody” and police would be less likely to investigate sexual assault allegations.

"The four suspects ... appear to have created an organised crime group with the purpose of recruiting, housing and exploiting women by forcing them to create pornographic content meant to be seen on specialised websites for a cost," Romanian prosecutors said in a statement on Dec. 29.
