"Posse Comitatus Act. On June 18,1878, after the end of Reconstruction, The Posse Comitatus Act was passed. Its purpose was to limit the Federal Government's power to use military personnel to assist in the enforcement of state laws."
What that tells me is that before 1878 the federal government COULD legally use the military on US soil. You know they were out west after the civil war killing Indians, too.
