This one is actually a bit more complicated and might have been a pardon no matter who was in office because of what he actually did created a very very uncomfortable and difficult precedent.
He created a platform. Yes it ended up being used to sell drugs and he probably was aware of it. But it created a legal mess where if he is guilty by definition it makes the person at the top of any only market directly culpable for the actions of every single user.
That is absolutely unworkable for the way the modern internet works.
IF someone uses AirBnbs to carry out prostitution than by association that makes Brian Chesky a pimp.
If someone sells stolen goods on Facebook Marketplace that makes Mark Zuckerberg personally liable.
That is not workable.
