She reserved her right to do so, without cause, and "You can't have your cake and eat it too" is a pretty clear indication that he's not treating Trump as a special litigant.

Normally, it would make no sense, but this is no normal litigation and she's already shown she's no normal judge.

Maybe she's waiting to get instructions from Trump?

Does anyone even find that surprising to consider?

Most likely. Classification is legallly irrelevant except perhaps in terms of novel, unarticulated and likely frivolous defenses, but so was Trump's civil suit in the first place.

It's a shame the DOJ is playing along, but I get why it has to. Unlike Trump, its responsible to more than itself and the case at hand.
