Yes, but only if you consider the context of the time. Freedom is kinda a spectrum. I think it's insane that drugs and prostitution are illegal, but I'll still say America is a free country, since when compared to other countries, Americans have more rights.
At one point, homosexuality was illegal in a lot of states. But during that time, banning homosexuality and other forms of gender non-conformity was very common.
