What percentage of the US population is comprised of Americans?

The Supreme Court has recognized that all ‘persons’ within the United States, including aliens, whether their presence here is lawful, unlawful, temporary, or permanent come under the protective scope of the Due Process Clause of US law.

Granting protection of US law to all 'persons' within US territory has merit only to high-minded people with strong moral principles. Such people are giving ICE a hard time both in the courts and in the streets to make America great not just for Americans but for everyone.

Nobody says the supreme court is correct
They can change their minds
Legal entry is important because of the vetting process etc
I believe under the Clinton administration immigration laws allow for "expedited removal" under which some individuals, particularly those apprehended at or near the border, may be removed more quickly with limited review. An officer can remove an alien deemed inadmissible under expedited removal without further hearing or review, provided the alien does not request asylum or assert a fear of persecution. While the Constitution guarantees due process, immigrants facing deportation are generally not provided with a government-funded lawyer. Policies can change, and attempts to expand expedited removal and limit due process rights have been a subject of ongoing legal and political debate.

Clinton: Reforms under IIRAIRA made it harder to claim asylum by imposing a one-year filing deadline and limiting judicial review.

@sree251

the language of the Fifth Amendment is interpreted to protect undocumented immigrants

Do you understand the word interpreted?

@PicturesOfABetterTomorrow

The Department of Homeland Security is reopening the Karnes and Dilley detention centers in Texas.
The administration has also expanded contracts with private companies to increase detention capacity at existing facilities.
Existing facilities in New Jersey, Ohio, Nevada, Oklahoma, and Mississippi have all expanded contracts.

Do you understand the word existing ?????

And blah, Blah, BLAH.

Look, I know you honestly have no control over what you think or say - you believe everyone (especially women) needs fixing and you've just got to do it.

But what you're raving about has nothing to do with with the point of this post - or what I actually said.

The question was aimed at a point of Constitutional law : Should "all persons" including aliens, be entitled to due process of law when inside US borders ?

What I said was that it seems strange that anyone who wants immigration rules enforced and borders respected should think the law has nothing to do with it. Because it's absolutely clear what the Constitution says about requirements for due process in the 5th and 14th Amendments.

And there's also nothing vague about what the "conservative" majority in the Supreme Court had to say about it either :

So get a grip dude. Everyone one knows that Obama, Biden, FDR, and probably Lincoln too lives rent free in your head, and they drive you crazy when they throw parties and don't invite you.

Life isn't fair. Get over it.
@GuiltyBiStander Due process is not intended to be exactly the same for a legal U.S. citizen as some one here illegally and facing deportation. Flexibility around that was how Obama and Clinton were able to streamline due process when they did it. You want to apply it rigidly/differently now, and ignore the broken laws that are the reason these people are even here. Accept flagrant ignoring of our laws to let them in but then expect absolute adherence to prevent their deportation.
That is not "upholding" the law .. its gaming and bastardizing it.

As to women .. I have no problem with women who are accountable, honest and fair in their dealings in life. I have issues with anyone who can't do those things, man or woman. Those people tend to respond to any disagreement or a boundary being held up to them with insults, claims about triggering, playing victim, false claims to sway others. Its the standard narcissistic responses. A lot of libs automatically go to those same behaviors .. yourself included .. when contradicted or challenged about their problematic behavior.

Everything you've just said is obviously your own opinion - and totally detached from the reality of law or facts.

I'm done wasting time on you.
Federal Authority over Immigration:

The Supreme Court has consistently held that Congress has broad authority to regulate immigration and has affirmed this power to the federal government.

Due Process Rights:
The Constitution requires that all non-citizens on U.S. soil be afforded "due process of law". However, the Court has clarified that these due process rights are limited for non-citizens facing deportation.

Expedited Removal:
The Supreme Court has ruled that expedited removal procedures, which allow for the swifter deportation of certain non-citizens, do not violate the Constitution's Suspension Clause.

Recent Actions

Restrictions on Deportation:
In a significant 2025 ruling, the Supreme Court prevented the Trump administration from using the 18th-century Alien Enemies Act to deport undocumented migrants, according to a YouTube video.

Third-Country Deportations:
The Court has also paused a lower court's order that would have prohibited the government from deporting immigrants to countries where they had no prior ties

No Right to an Attorney for Deportation:
In the context of civil immigration proceedings, the Supreme Court has affirmed that non-citizens do not have a constitutional right to an attorney, as these are administrative, not criminal, processes.
@TallMtnMedic The US Constitution says
... nor shall any State deprive any person of life, liberty, or property, without due process of law ...

Any person, that means every human being in the US gets due process including criminals, "illegal aliens" etc etc.

Need to see what SCOTUS has ruled??
Shaughnessy v. United States ex rel. Mezei, 345 U.S. 206, 212 (1953); see also Mathews v. Diaz, 426 U.S. 67, 77 (1976) ("There are literally millions of aliens within the jurisdiction of the United States. The Fifth Amendment, as well as the Fourteenth Amendment, protects every one of these persons from deprivation of life, liberty, or property without due process of law."); Plyler v. Doe, 457 U.S. 202, 215 (1982) (holding that unlawfully present aliens were entitled to both due process and equal protection under the Fourteenth Amendment).

Here's a bit more from Mathews v. Diaz 1976 including citations of prior rulings.
There are literally millions of aliens within the jurisdiction of the United States. The Fifth Amendment, as well as the Fourteenth Amendment, protects every one of these persons from deprivation of life, liberty, or property without due process of law. Wong Yang Sung v. McGrath, 339 U. S. 33, 339 U. S. 48-51; Wong Wing v. United States, 163 U. S. 228, 163 U. S. 238; see Russian Fleet v. United States, 282 U. S. 481, 282 U. S. 489. Even one whose presence in this country is unlawful, involuntary, or transitory is entitled to that constitutional protection. Wong Yang Sung, supra; Wong Wing, supra.

Even one whose presence in this country is unlawful, involuntary, or transitory is entitled to that constitutional protection.

Thank you, SCOTUS for being clear, unambiguous, and leaving zero wiggle room.

Leaving zero wiggle room for US law enforcement to enforce the law?
That was before 12MM or so were illegally allowed into the country .. with nefarious intents behind doing so

Desperate times call for desparate measures .. Clinton and Obama both deported illegals under a streamlined version of due process. What's different ?

The legal system is being used by Dems to try and block similar actions now because it hurts their nefarious intent .. which is to use these illegals in the census to game the system in congressional seat allotment, ultimately even likely moving to allow them to vote .. already under pressure for local and state elections in several places.

Those same "High minded" individuals in the post are who concocted this scheme .. which is why they oppose streamlined due process now.

If you know .. you know.

Maybe its time for some modern day revolution to set this sh!t right.

It's always interesting to see how many people who claim they want to make America "great again" think they can do that by ignoring our laws - And how few people who call themselves "patriots" have actually read the Constitution, and understand what it means.

@BrandNewMan how did Biden let “Millions” in, considering he deported more in his first term than Trump did in his?

Up yours!
@trollslayer Not a correct fact anywhere in that ..

Biden had 1 term .. not 2

More illegal crossings in that 4yr term than the prior 12 yrs combined

But really I appreciate your comments. And I'm sure you'll feel better - someday.
@GuiltyBiStander Right 🤣

Look again .. only those who are lying .. making blatantly false claims ..playing at double stds .. assigning invalid claims of racism and other baiting things on a personal level with no cause .. fearmongering .. justifying violence over your superiority to try and scare those who disagree with you.. Why ? Because you arent getting your way and your cause is lost in its own ineptness.

I dont do any of that. Why wouldnt I stand up to it and push back instead of take it?
It's not just the SCOTUS. It is clearly stated in the constitution.
Vin53 · M
You can't tell cons that though. All immigrants are illegal regardless.

This isn't even happening... So yeah, more drivel from the guy that loves authoritarians and believes Jews killed the Russian Tsar and his familly and then created the USSR.
