This signifies the difference between a premeditated act of murder and a crime of "sudden passion", committed without planning and when two or more people are engaged in confrontation. He didn't plan the event, and Texas appears to recognize crimes of sudden passion.

Seems like a strange example to use for the death penalty, when you have the more legitimate targets of baby murderers, child killers, and so on. This guy wasn't a coward, he took it straight to the person, and he didn't try to hide it.

That said, he should have walked away.

Why not just keep him in jail?

Those states that allow to do that if he really is guilty will find a reason to let him loose anyway. Just a different way.

@MistyCee and probably he'll be a better man for her. The law took me away from my last living close relatives. I'm the victim, but I have to stay away forever because I'm triggering to them. That's the law. I think my family will be nice, safe to be around - to everyone except me. I accept that.
