He can't be fired but he can be impeached. No he should not resign. There is sufficient evidence that a criminal act was committed and thus needs to be investigated.

Without a warrant and investigation he didn't have any evidence.
hippyjoe1955 · 61-69, M
Actually he did have everything he needed. In legally amassing evidence regarding one crime the police/FBI came across evidence of another crime and properly took out a warrant to investigate the second crime.

He can be impeached by congress. Pretty sure Clinton & Reno fired Sessions.
doctorlove · M
And really, Clinton fired him - with Reno's advise

@hippyjoe1955: his letter preceeded the warrant by a few days atleast. So there is no way he knew if there was anything incriminating at the time he released the letter.

The director of the FBI serves at the pleasure of Congress and not the President. That way the FBI can investigate anyone with just cause including the president should (s)he commit a crime.
hippyjoe1955 · 61-69, M
@BigAsset: Don't be daft. Comey had lots of evidence of criminal activity in July. He simply said, and I paraphrase, there wasn't political will to proceed. Now Obama has said Comey is simply doing his job there seems to be a turning of the tide.

The FBI is responsible to the Attorney General - not congress.
hippyjoe1955 · 61-69, M
But the directer is confirmed by congress.

@hippyjoe1955: yes.. they can investigate. No one questions that. But to write that letter without any credible info and facts before election time was definitely not appropriate .

@BigAsset: [big]65,000 Emails[/big] (on ONE Laptop) isn't Evidence?!?

Ummm ... this isn't "hacked stuff" ... (Much of it Classified US State Dept Secret Stuff!)

This is the "Oh, I forgot about those! *giggle*" emails on Huma Abedin's Personal Laptop Computer...

Hillary will have Someone killed over this.
SW-User
@hippyjoe1955: as per law he can be fired, demoted, temporarily suspended etc if he it's proven he 'intentionally' violated the Hatch Act.
hippyjoe1955 · 61-69, M
@BigAsset: There is so much evidence of a crime having been committed that even a blind man can see it. Unless of course said blind man has his head so far up Hillary's butt he can see the phloem she is about to chock on.
hippyjoe1955 · 61-69, M
@BigAsset: Which he didn't do. But even if he had he would have to be impeached if he dug in his heels.
SW-User
@Th1nkF1rst: pls get your facts right :
1. It's wieners computer.
2. No one knows if they are classified info. That's what they are investigating.
doctorlove · M
@BigAsset: But ... but ... [big]Emailz!!![/big]
SW-User
@hippyjoe1955: its comey who said there's no prosecutable evidence in July. It wasn't me.
SW-User
@doctorlove: hehehe

From Comey's July statement:

From the group of 30,000 e-mails returned to the State Department, 110 e-mails in 52 e-mail chains have been determined by the owning agency to contain classified information at the time they were sent or received. Eight of those chains contained information that was Top Secret at the time they were sent; 36 chains contained Secret information at the time; and eight contained Confidential information, which is the lowest level of classification. Separate from those, about 2,000 additional e-mails were "up-classified" to make them Confidential; the information in those had not been classified at the time the e-mails were sent."

That is evidence of a crime. Further evidence is simply further evidence.

Let's take this out of the political for a second. The local police suspect someone of murder but can't find enough evidence so they don't make an arrest. Then one day they are investigating a theft and find a murder scene with all kinds of evidence that points to the suspected murderer. Is the police prohibited from investigating the murder because they were investigating a theft.

@hippyjoe1955: to the last point - the police should investigate. No one is disputing that. But sending out a letter to all and sundry without a warrant and proper investigation is rather stupid.
hippyjoe1955 · 61-69, M
Actually the police often inform the public about their investigation. The people have the right to know that when a crime has been committed that the police are aware of said crime and are actively investigating that crime.
SW-User
@hippyjoe1955: we still don't know if a crime is committed!!! That's the whole point. That's what they are investigating!
hippyjoe1955 · 61-69, M
Did you read the article I posted from July? Yes a crime has been committed. You can not have that level of classified material on a non government computer. Full Stop. The material recovered was on a non governmental computer/server that belonged to Hillary. Now there is a bunch more emails from the same server, 650000 or there about that were on an even less secure computer. Yeah there is more than enough evidence that a crime was committed both by Hillary and by Huma. BTW did you ever wonder why Huma would keep those emails in a folder called "Life Insurance"?
SW-User
@hippyjoe1955: then maybe comey should resign for incompetence.
hippyjoe1955 · 61-69, M
No he simply told the truth. The DOJ (under the influence *cough {threat} cough* of the Clinton Crime family were not going to prosecute Hillary. Remember that highly illegal meeting between Bill and Loretta where they discussed grandkids and golf?
