It's not a matter of legality. It's about the way the "law" is changed and employed. The fact is, the majority of migrants who overstay their visas do it by flying into the country, but we're not worried about that status. Others are walking right over the Canadian border, but we're not concerned with that skin color. Half of all immigrants are white. Why aren't they in chain link detention pens? Why is it just brown, poor people along one border?
