@TheProphet I see. That’s not good enough. I don’t think that judges should be political hacks. They should be appointed based on their impartiality. No different than I expect a juror to be if you or anybody were to be prosecuted for some reason.

@SimplyTracie Entirely unrelated, Doug Ford, other than he may be taking cues and found a hole in the Charter of Rights in Canada. So four years ago, Doug could not get elected as Toronto mayor, at the time blamed 'leftist' populism and politics. Once he's elected Premier of Ontario, he reduces the size of Toronto city council from 44-25 (set to increase to 47), during mid municipal election.

Toronto takes the province to court. The judge hears the case, and determines that as this was during mid-election the province is violating the right of freedom of expression. His ruling, in turn, throws out the legislation, as it ruled unconstitutional, so what does Doug Ford do? He's invoked the 'not withstanding' clause in the charter where rights of citizens can be revoked. Saying that courts don't get to rule over democracy, that he was elected (without saying he would do this), and not some appointee.

Well that appointee had a freaking clue of rights. There is a reason for a blend of democracy/judicial

@TheProphet Of course they need to individually interpret constitutional law.

Kavanaugh, as a lower court judge said he has accepted the decisions of the SCOTUS but at the same has said that Roe v Wade isn’t settled. I don’t think you can have it both ways.

@SimplyTracie There is no such thing as Settled Law. The Supreme Court changes laws all the time.

@TheProphet You like my comment? I don't know that it favours your argument you've given so far. Toronto citizens are against the move, they are further against the Premier using the not withstanding clause, and how he can plausibly argue this is democracy.

@SimplyTracie Roe was wrongfully decided and should be overturned. Since you're not in favor of changing settled law then Dredd Scott would not have prevailed and slavery would still be legal. Or Brown vs Board of Education. Schools would still be segregated.

@TheProphet It’s not for us to decide. And I don’t think a judge should be appointed based on a predetermined position. As surfcrabby said, I won’t change my mind.

@SimplyTracie He never gave an opinion on anything of substance which has pretty much been the rule for nominees for decades no. And yes I think all the shit spread by liberals about him is lies and fake news. That's why almost all of them said they would vote against him before his name was even picked. They never had any intention of giving him a fair hearing.

@TheProphet There opinions was probably based on his previous decisions made as a lower court judge or at previous confirmation hearings. I don’t know. But it might be all stuff they made up out of thin air.

@SimplyTracie No hon. They announced that they were going to vote no no matter who Trump nominated. That's how biased the dems were. He will be confirmed and I think at least 3 dem Senators will vote for him.
