(1) In general Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien's status, may apply for asylum in accordance with this section or, where applicable, section 1225(b) of this title.
For decades, US immigration law and policy was designed to spit in the eye of Fidel Castro by treating everyone who set foot on Florida as an asylum seeker. This helped earn votes from a swing demographic in a swing state. I agree, we need immigration reform. The solution is better laws, not new declarations of emergency.

I'm not saying any particular person or group is guilty or innocent. I'm saying you can't establish either guilt or innocence without due process. How do you know they're illegal? You don't, and without due process, neither does ICE.
