Georgia judge issues rulings upholding election integrity

Judge Robert McBurney ruled Monday that election officials' role in certifying votes is merely "ministerial," noting that the law says votes "shall" be certified by the deadline. A lawsuit had been brought by a Republican official seeking to delay certification if she felt something was "wrong" with the totals. McBurney ruled that disputes over election integrity are the province of the courts, not partisan election officials.

Yesterday, McBurney issued a temporary restraining order on a law requiring that all ballots be hand-counted on election day, which would delay reporting the results (the initial count in Georgia is by machine). The case also allows partisan poll watchers greater access to more areas in election facilities, and is set to be heard by a different judge today. A separate case allowing election officials to delay certification if they choose to conduct a "reasonable inquiry" is still pending, but given McBurney's ruling, is probably also doomed.

It's reassuring that there are still Republicans like Georgia Secretary of State Brad Raffensperger who are not kowtowing to Trump and are instead committed to holding elections without allowing other Republicans to create chaos and undermine the process.

My favorite paragraph from the ruling:

“Importantly, election contests occur in open court, under the watchful eye of a judge and the public,” he wrote. “The claims of fraud from one side are tested by the opposing side in that open court – rather than being silently ‘adjudicated’ by a superintendent outside the public space, resulting in votes being excluded from the final count without due process being afforded those electors.”

In other words, elections, counts, etc CAN be challenged, but only in open court under the public eye.
