Jonathan Ross released his own video from his phone. This is proof that his attention was on the video he was making rather than on the vehicle he walked in front of. Making videos with your own phone is NOT part of the job description of an ICE agent.
Jonathan Ross didn't begin firing his weapon until he was out of the path of the vehicle. He shot a fleeing "suspect." This is against ICE rules and policy. 4) Deadly force is not authorized solely to prevent the escape of a fleeing suspect. Deadly force against a fleeing subject is only authorized if there is probable cause to believe that the escape of the suspect would pose an imminent danger of death or serious bodily injury to the officer or another person.
Also, Department of Homeland Security (DHS) guidance—specifically, 2014 ICE/Border Patrol use-of-force policies—
“It should be recognized that a half-ounce (200-grain) bullet is unlikely to stop a 4,000-pound moving vehicle, and if the driver … is disabled by a bullet, the vehicle will become a totally unguided threat,” it says. “Obviously, shooting at a moving vehicle can pose a risk to bystanders including other agents.”
What Jonathan Ross did while filming his video is an example of a law enforcement pattern known as "officer created jeopardy," which is way too common in vehicle stops. It involves an officer intentionally stepping in front of a moving vehicle to create an excuse for deadly force. It's been affirmed as a defense for drivers in SCOTUS Barnes v. Felix 2025.
This pattern is why the DoJ's own use-of-force policy says that agents may not fire at a moving car that is threatening them unless “no other objectively reasonable means of defense appear to exist, which includes moving out of the path of the vehicle.”
In this case, Officer Jonathan Ross stepped out of the path of the moving vehicle -- the EXACT means of defense the DoJ cites -- and after defending himself, fired three shots as the vehicle was passing by.

1. Pitting of religious, racial, and economic groups against one another in order to break down national unity is a device of the "divide and conquer" technique used by Hitler to gain power in Germany and in other countries. With slight variations, to suit local conditions, fascists everywhere have used this Hitler method. In many countries, anti-Semitism (hatred of Jews) is a dominant device of fascism. In the United States, native fascists have often been anti-Catholic, anti-Jew, anti-Negro, anti-Labor, anti-foreign-born. In South America, the native fascists use the same scapegoats except that they substitute anti-Protestantism for anti-Catholicism.
Interwoven with the "master race" theory of fascism is a well-planned "hate campaign" against minority races, religions, and other groups. To suit their particular needs and aims, fascists will use any one or a combination of such groups as a convenient scapegoat.
2. Fascism cannot tolerate such religious and ethical concepts as the "brotherhood of man" Fascists deny the need for international cooperation. These ideas contradict the fascist theory of the master race. The brotherhood of man implies that all people-regardless of color, race, creed, or nationality have rights. International cooperation, as expressed in the Dumbarton Oaks proposals, runs counter to the fascist program of war and world domination.
In place of international cooperation, the fascists seek to substitute a perverted sort of ultra-nationalism which tells their people that they are the only people in the world who count. With this govt hatred and suspicion toward the people of all other nations. Right now our native fascists are spreading anti-British, anti-Soviet, anti-French, and anti-United Nations propaganda. They know that allied unity now foretells the certain defeat of fascism abroad. They know that post-war allied unity means world peace and security. They realize that fascism cannot thrive or grow under these conditions.
3. It is accurate to call a member of a communist party a "communist." For short, he is often called a "Red." Indiscriminate pinning of the label "Red" on people and proposals which one opposes is a common political device. It is a favorite trick of native as well as foreign fascists.
Many fascists make the spurious claim that the world has but two choices either fascism or communism, and they label as "communist" everyone who refuses to support them. By attacking our free enterprise, capitalist democracy and by denying the effectiveness of our way of life they hope to trap many people.
Hitler insisted that only fascism could save Europe and the world from the "communist menace." There were many people inside and outside Germany and Italy who welcomed and supported Hitler and Mussolini because they believed fascism was the only safe-guard against communism. The "Red bogey" was a convincing enough argument to help Hitler take and maintain power. The Rome-Berlin-Tokyo Axis, whose aggressions plunged the world into global war, was called the "Anti-Comintern Axis." It was proclaimed by Hitler, Mussolini, and Hirohito as a "bulwark against communism."

BTW, apparently Obergruppenführer Stephen Miller has set such draconian quotas that ICE agents are terribly overworked and under-rested (yeah, boohoo for them). And after the murder of Renee Nicole Good they really have to watch their backs.

ChongLy "Scott" Thao told the AP that his daughter-in-law woke him up from a nap Sunday afternoon and said that U.S. Immigration and Customs Enforcement agents were banging at the door of his residence in St. Paul. He told her not to open it. Masked agents then forced their way in and pointed guns at the family, yelling at them, Thao recalled.
"I was shaking," he said. "They didn't show any warrant; they just broke down the door."
... Thao said agents drove him "to the middle of nowhere" and made him get out of the car in the frigid weather so they could photograph him. He said he feared they would beat him. He was asked for his ID, which agents earlier prevented him from retrieving.

Video on social media verified by The New York Times shows several agents tussling with the man before bringing him to his knees.
The man appears to resist as agents grab his legs, push down on his back and strike him repeatedly. This video does not show what led to the episode.
The footage shows an agent approaching and grabbing at the man as other agents hold him down.
An agent appears to pull a gun from out of the scrum.
Simultaneously, another agent unholsters his firearm. That agent aims at the man’s back and appears to fire one shot at close range. He then appears to continue firing at the man, who collapses.
Two agents appear to fire at the man as he is motionless on the ground.
In total, at least 10 shots appear to have been fired within five seconds, according to the video.
Footage of the encounter shows the man was holding a phone in his hand, not a gun, when federal agents took him to the ground and shot him. There was no evidence that the man who was fatally shot opened fire.
