Because the courts are allowed to be manipulated by party lines, because they can be bribed/coerced to say whatever they want, because they can interpret anything to match an agenda and not care about the needs of the general population.
I am sorry, but it seems there is no stopping this short of converting to communism, and then you get whatever your leader decides and everyone else is pushed quietly off balconies.
