ANYTHING congress with the president does will simply get overruled as unconstitutional by especially this supreme court.
@DeWayfarer The long term solution to this (and a whole host of other problems brought on by tRump’s incompetence) is for President Biden to expand the SCOTUS and pass term limits for judges and perhaps Senators and Congressmen.

Then each issue would have to be re-litigated. I would start with assault weapons, high capacity cartridges, and bump stocks since they had been banned before, then universal background checks, revoke “stand your ground rules,” plug the gun show sales loopholes, etc.

@KunsanVeteran I believe Biden is a bit worried that expanding SCOTUS is an unending game. For if Trump gets back in he can as well expand the SCOTUS again.

Waiting for others to retire is better if Biden gets back in. He'll just appoint who he needs to. Biden has already said he doesn't want to expand the SCOTUS. I believe that's the reason.

Term limits just will never happen by either party. 😞

Heck this SCOTUS would likely rule it unconstitutional. They are all about States rights. And leaving it up to individual states voters.

That's the problem. NONE of that is in the Constitution. The tenth amendment is the whole problem. Just simply remove it! It's no longer necessary!

It's not an individual! They had to write it in because a state is a concept rather than a individual.

The tenth amendment is why corporations are considered individuals though. All because of the tenth amendment gives rights to the states AS individuals.

The tenth amendment was apart of the ten original bill of rights. It should have never been put in. It's what makes this a republic and not a democracy.

Note democracy is never even mentioned once in the Constitution. Republic is once.

The preamble they really didn't want to put in! It was too democratic.

They wanted a Republic with just a few rights given, here and there, to certain individuals. Three fifths of a vote to slaves. Because they are not a whole person by their thinking.

Heck American Indians didn't have the right to vote at all until 1924. They weren't even considered a human individual. Nor were women.

All this points to the USA being a Republic.

Make it a democracy then we don't even need senators as in senators of the Roman Republic. With only "citizens" having the right to vote. Basically land owners with a few exceptions, like officers in the military. Free people couldn't vote! They went in the military as officers, specifically to become citizens with the right to vote.

All this type of thinking needs to change in the Constitution. With words that specifically state democracy. Along with a lot of other RIGHTS for only REAL human individuals!

@Diotrephes even now federal law is supposed to take precedence. Just no enforcement is done on many federal laws.

Sorry to tell you but you missed the galaxy with that comment. Slaves had ZERO rights and could never vote on anything. The three fifths clause was added to give the Whites in the slave States additional representation in the House of Representatives because without the slaves being counted in the population, the slave States would have had even fewer representatives in Congress. Black men didn't get voting rights in America until February 3, 1870.

"The Three-Fifths Compromise, or slave trade compromise, was an agreement reached by members of the Constitutional Convention in 1787. The Three-Fifths Compromise provided for the enumeration of 3/5ths of the enslaved population in a state to determine the number of Representatives in Congress each state would have. It also outlined rules for apportioning federal direct taxes and the number of electoral votes for each state."

Biden won't live that long. But if he did, he would need a super-majority in both houses in Congress who would carry out his desires.
@Diotrephes And that’s coming. President Biden will have no difficulty living through another full term unless some delusional tRump cultist actually succeeds in assassinating him ( but I’d bet on the Secret Service any day over deranged tRumpists.

The poor couldn't take the time to vote. A gun? It cost years wages.

The main purpose of the Second Amendment was to give the slavers the means to put down slave rebellions and to ensure that settlers had the means to kill hostile Indians.
