Teacher shot by 6 year old is taking school and district to court

She says they ignored her repeated warnings that the 6 year old had a gun.

6 year olds parents claim the gun was “secure” at home in a locked box.

Guns kill people.

Guns? Are you sure? We have several guns and they've never killed anything. In fact they have never moved or done anything on their own. Now when My husband loaded gun and pulled the trigger after aiming it at a deer, The bullet killed a deer.

But wait, I wonder if it was the person who did it???

Does the 2nd Amendment have an age limit?
Does the 2nd Amendment say six year olds can't have guns?
Does the 2nd Amendment ban guns from schools?
The answer to all is "no" isn't it.

If you're a 2nd Amendment purist, how can you ban six year olds with guns from schools?

The Constitution does allow for states to define an "age of majority", usually 18. Persons younger than this age are considered minors, and must be under the care of a parent or guardian unless they are emancipated. Minors are treated differently from adults for many legal purposes including privacy of official records, punishment in criminal matters, or the ownership or transfer of property.
@Coffeequilt The Constitution makes several mentions of rights received upon reaching majority, such as marriage and voting. The right to bear arms is NOT encumbered by any such limits.

So your answer is NO.

The second Amendment does NOT ban six year olds from having guns.

And NO, the 2nd Amendment does NOT ban guns from schools.

Instead, you're searching around for some hint of laws in some way SUPERIOR to the 2nd Amendment.

@Coffeequilt Actually, Scalia answered that one a while ago. 2A confers the right to bear arms. According to Scalia's reasoning, if you can't carry the weapon then it's not covered by 2A.

BTW, you NRA types have been systematically eliminating state laws on licensing and carrying. In other words, you've been placing state laws as INFERIOR to 2A. Are you ready to declare SCOTUS wrong on all the recent eliminations of state laws???

And, more specifically, since the Second Amendment doesn't limit the right of a six year old to possess a gun and bring it to school, what DOES limit the right of a six year old to bear arms?? What, in your legal knowledge, is SUPERIOR to the Second Amendment??
