Filing for dissolution when living in separate states

If I filed for a dissolution and sent him the paper work could he just sign and both of us not have to appear in court?

He could... but I doubt that he would - sometimes, it's easier to make your ex suffer as much as possible, especially if you don't want to split up the marriage.

@HootyTheNightOwl I want to split it. We’ve already separated and he’s moved out of state
@Blondie1977 You might... its up to him to feel the same way, though.

He might agree and sign or he could drag it out because you petitioned before he did.

@HootyTheNightOwl oh I know. I wouldn’t even file unless I was positive hed sign. Because then it would be a full blown divorce and no need for that
@Blondie1977 Do you have any backstop where you can divorce after being separated for so long, regardless of if your spouse agrees or not???

Over here 5 years of separation can enable a divorce for desertion.

@HootyTheNightOwl we’ve only been apart less than two weeks so I’d say no lol
