I think you hit on the million dollar point, and that is the absolute dereliction of duty by Congress for the better part of the last 50 years (although, I'd go back about 10 years further). For anyone who dislikes judicial overreach or presidents wielding too much power, this is a direct result of the consistent abject failures of Congress to perform its duties. If clear and concise laws were being negotiated and passed in good faith, the courts wouldn't have to perform logistical gymnastics to interpret them. If Congress retained control of its authority to declare war instead of writing blanket permissions to the White House, we wouldn't have to worry about presidents abusing our military and engaging in conflicts unnecessarily. The last time Congress actually declared war was 1941, but look at all the wars we've engaged in whilst the cowards in Congress hid behind the the sitting president as to avoid blame when it went sideways. If Congress stepped up and owned its role, the other two branches would not be in a position to overreach to fill that void. Congress is and has been the root cause for decades. @Timb63
