as far as i'm concerned Helena Silverstein more than made her point effectively and utterly dismantled the case for Parental consent and notification statues on the grounds that the court system is not prepared for or capable of properly adminstering the judicial bypass statues laid out in the law.
It is an undue burden and onerous expectation to place on minors of abusive parents seeking redress and injuntcive relief against this requirement, whether or not it meets the standards of Casey, means little to me personally because i would rather go by common sense standards of undue burdens.
There really is no need to put them through all of this shit, Parental notification laws and consent laws are a solution in search of a problem that was never properly articulated to exist in the first place of teenagers seeking to conceal their pregnancies from their parents.
Teenagers are Secretive, I will give the parental rights crowd that much but there are imits on just how secretive, when they find themselves in serious trouble like pregnancy all rules and normal teenage rebellious behavior tend to go out the window on the grounds that the teenager realizes they are screwed and thus reaches for her parents quite naturally, and if she doesn't- that's a bad sign that something is goingo n there where she doesn't feel safe telling the about it.
I just finished the book on stream and honestly Helena is one of my Heroes for writing this book.
She utterly ruined the case for these statues.
it was as I described a brutal talke down of the case for them. the scrunity applied here has been rather scorched earth.
The state should not be in the business of compelling minors to notify their parents of their medical decisions.
if they don't do it naturally, we should not force them.
