From what I read - you can probably find a lawyer who would file the suit.
HOWEVER, you could most likely expect CPS to descend on you like you have never seen. It seems to work that way.
Do the parents at the school have a website or somewhere you can post complaints? Maybe if you can get support there.
Do understand that schools are bureaucracies and the common reaction of bureaucracies when under fire is to circle the wagons and punish the complainer. It is most certainly not fair, but it's what usually happens.

@ChosenOne A bonnet? You mean you're not PTA tea-compatible?

@ChosenOne I meant not the kind of woman whose shoes match her dress and who looks down her nose.
Based on the information you provided, there may be several issues that you could pursue legal action for, but it is important to speak with a lawyer to fully understand your legal options and the likelihood of success for each potential claim. Some of the potential issues include:
Failure to address a credible threat: If the school failed to take appropriate action to address the student's threatening statement and to ensure the safety of all students, this could be considered negligence and could potentially be the basis for a lawsuit.
Discrimination: If the school called CPS on you without justification and based on false allegations of drug use, this could be considered discriminatory and could potentially be the basis for a lawsuit.
Medical negligence: If the school nurse failed to administer your child's medication properly or failed to follow proper protocols for addressing your child's medical needs, this could potentially be the basis for a lawsuit.
Educational disruption: If your child's frequent absences and the school's lack of accommodations for your child's medical needs caused significant disruption to your child's education and led to you losing your job, this could potentially be the basis for a lawsuit.
Again, it is important to speak with a lawyer to fully understand your legal options and the likelihood of success for each potential claim.
