It's a delay tactic. The judge does not want the case to be argued prior to the elections. She cannot dismiss the case, but she claims the special counsel, was appointed in violation of the Constitution.
The decision will be appealed, but the elections are a mere 100 days away.

@Northwest By dismissing the case, I presume Jack Smith can immediately re-indict in either DC or NJ. And Smith may have even more options.
I doubt that you can appeal a dismissal per se. Charges would need to be re-filed. But since tRUMP committed the crime in multiple jurisdictions, presumably DC would be the most logical.
