I don't know the logistics of the case mentioned but in general :

Local law enforcement CAN'T enforce FEDERAL immigration laws & are being told NOT to cooperate with FEDERAL actions meant to deport illegals

Local law enforcement can't ask a person's status

It's easy for a case to fall thru the cracks
It wasn't a priority

There are lots of reasons why he wasn't previously deported

I'm NOT law enforcement
I'm NOT the government
So how would or the general public know
He probably should have been on the sex offenders list but since local doesn't enforce immigration status he wasn't previously deported etc
