So they have the files, they can persecute whoever is in them, but they aren't - that's all you need to know about the justice system. People don't have the power anymore "in the land of the free"

I went ahead and read about what happened.
It was the public that prevented the arrest.
And it is clear why. It is a natural escalation of a 2,500% surge in non-criminal detainees over the past year (Jan 2025 to Jan 2026), largely due to "collateral arrests" where individuals with no criminal record are detained during operations targeting others.
The public has reasonable ground to no longer trust ICE claims.
If you wish to solve this, the next step would be to end the illegitimate arrests and targeting of non convicts.
Otherwise, it will continue to happen.

I don't know the logistics of the case mentioned but in general :
Local law enforcement CAN'T enforce FEDERAL immigration laws & are being told NOT to cooperate with FEDERAL actions meant to deport illegals
Local law enforcement can't ask a person's status
It's easy for a case to fall thru the cracks
It wasn't a priority
There are lots of reasons why he wasn't previously deported
