Why didn't Thomas mention Loving vs Va as a substantive due process case that should be overruled?

I think I know the answer, obviously, but can anyone give me a less cynical one?

@Dshhh Maybe not too cynical, but it doesn't make much sense. If he really wanted to get rid of Ginny, he could have mentioned Loving.

Honestly, I dont think other of them are much of a credit to their race, gender or even species. They probably deserve each other.
