Ironically, religion could be the answer for challenging the overturning of Roe v Wade. ~

Jewish (Halachic) law permits and sometimes requires abortion, especially when the life/health of the pregnant person is at stake. Jewish women could sue based on religious freedom requiring the right to abort a pregnancy. Abortion rights may not be guaranteed by the constitution, but religious freedom certainly is.

The Aztec religion requires human sacrifice, so does that mean that all states should legalize murder? This is a poor argument. I personally support abortion but there is nothing in the constitution guaranteeing the right to abortion, so it should be left up to the states.

@fschmidt But the Constitution does guarantee freedom of religion, which is my main point. It's not an argument but a fact. Courts may act and rule as they see fit.
