Do you pay rent to your common law spouse?

My sister has been with this guy for about 8 years. They owned a house together, sold it and then four years ago had a house built on a large lot he owns. I just found out that she is not on title to this new house and that she has to pay him rent. Is this normal?!!
It could be her share of the mortgage. Though I don't why she would call it rent. But I know couples who go in half on the bills. Then there are those couples who just get the bills paid and split or come to an agreement on how to spend the rest or decide where it should go.

Is it some tax/benefits scam?????

@Fluffybull good question!

Sharing responsibility is normal but why phrase it as paying rent. That sounds odd. She is sharing responsibility.
If they intend to be together long term she should consider having a legal vested intrest in the property but again some people are content to just allow their partner to own certain things.
I own a property that my husband dosen't but we are married so in the event of a divorce he would definitely be inclined to get half.

An owner of a resident can charge rent or not charge rent to people living there.

@MrBrownstone but I don’t understand why he charges her rent.

@MrBrownstone he may be able to claim some of the mortgage interest against the declared rental income which may again help THEM financially

If she was on the Title she would be paying part of the mortgage so rent makes sense to share expenses
GJOFJ3 · 61-69, M
@Spoiledbrat She has to make that decision. If his debt ratio is too high she maybe doesn’t want to be responsible for that
Jenny1234 · 51-55, F
@Spoiledbrat my thinking exactly

hen she wouldn't co own the property. I wouldn't sell myself short like that. She wouldn't be building anything. It would be all his. Why waste a life with someone like that? I mean she's good enough to live with but not co own his house. He would be using her.
This is exactly it! And it's all his if they never get married and she paid for nothing. I was in this exact situation with a partner in the past per my post on this thread. I'll pay half the utilities, not for your equity through "rent". Unless I'm on the deed.
Mostly I have seen this (married or common-law) when both work and the mortgage or payment/rent is proportional, adjusted based on their income.

If two are married and have a joint account, the result is about the same.

I know a couple who live together but for Universal Credits (Social Security Houseing benifits) reasons she is renting from him they are paying the Mortgage like this
DeluxedEdition · 26-30, F
That’s weird 👀
DeluxedEdition · 26-30, F
@DeluxedEdition she and him knows it too that’s why you “just found out”
Jenny1234 · 51-55, F
@DeluxedEdition she and I aren’t close so I was actually surprised she told me.
That seems unusual in marriage...
Jenny1234 · 51-55, F
@NerdyPotato they are common law but still it does sound weird eh
justanothername · 51-55, M
@NerdyPotato very unusual.

She is a foolish lady
My state doesn’t have "common law" marriages. So if they lived here and didn’t co-own the home, she’d legally only be a tenant.
Fluffybull · F
@bijouxbroussard Same as here in the UK. No such thing as common law wife or husband. I've heard of people claiming benefits to pay "rent" or "lodgings" to a "landlord" but it was really their boy/girlfriend.
Fukfacewillie · 56-60, M
Nothing normal about it.
MonaReeves86 · 36-40, F
How much does she pay
iamonfire696 · 41-45, F
If they broke up she would have claim to the house in the province I live in.
