So how many years is he spending in jail, what kind of prison is it a rough one

He will leave jail once he is sentenced. He will be in protected custody and he will be afraid of every black man inside for 40 years which is how it should be. Prison is famous for levying out the final justice.

Absolute max...

Second degree murder, 40 years.
Third degree murder, 25 years
Second degree manslaughter, 10 years.

If served consecutively.. 40 years max. If served separately... 75 years max.

Consecutively is most likely.

Now having said that. He can get out at ⅓ of the time on all the above. He still would be under supervision under a case worker of some sort.

Yet... There is still the Blakely charges. And he did commit the murder in front of a 9 year old child if nothing else. There are other charges possible.

What few expect is, that he can not only get off on appeal, yet it is possible that he could get damages for a wrongful conviction.

This not over by a long shot!

And that greatly saddens me. 😔

The most amount of time he can serve is 20 years. Some research I’ve done it seems that the average sentence in a 2nd degree murder conviction in Minnesota is around 14 years and time served is 9-10 years.

@JesseInTX The appeals process should be interesting. The judge has already cited Maxine Waters' remarks as one basis.

@eli1601 very true. They can appeal the evidence or present witnesses but the appeals process is about procedural errors made by the court. Fair trial, sequestration, undo influence on the jury, etc. My opinion is the convictions won’t get overturned but there is the slight chance on the 2nd degree murder charge.

because he is a cop he will get preferred treatment in jail. prisoners don't like cops and because cops have to protect him. His life in prison will not be as bad as it should. however, he will not have a good time regardless
