Late Monday, National Transportation Safety Board officials said that the train, bound from Seattle to Portland, Oregon, was traveling at 128 km/h, on a curve with a limit of 48 km/h, when it jumped the tracks

I mean there is no excuse ... Unless there was some mechanical failure it's manslaughter
