If someone purchases a car from a delearship two years ago (read below?

Whenever I bought it a check engine light came on . Not even a week later I took it back to where I bought it from and the guy told me there was an electrical problem in the engine and it took them over a month to figure out what was wrong with it and two years later (today) I got a letter in the mail saying they are sueing me for the full price of the car that I didn’t even have for 3 days. They are sueing me for over 6 grand .

Additional information
*Purchased in state of Delaware
*No loan was taking out for car
*In house finacing
*Sold me a “lemon law” car
* I paid over a grand in cash for the down payment
* It was a used car
Why can they sue me for a car that I haven’t had in over 2 years ( I just paid off the car I do have and own it now ) and for a car they sold me with problems and they kept?
What are the options ?
*Asking for someone those are their exact words .

Get a paralegal...and let it go to court. There is a very, very strong chance a judge will side with you, so they will not go all the way. Slow down the process and let them blow money on their lawyer. Often this type of thing is just a hope of getting some cash with a threat.

Challenge the dealer to go on Judge Judy with you and watch as she rips them apart in front of ten million viewers.I bet they drop the matter before the TV show is filmed.

I'm not sure what the laws are there, but in Michigan every car sale is "as is" unless there is a written agreement for the seller to provide a warranty. If you didn't take out a loan or sign any kind of promissory note they shouldn't be able to hold you responsible for the remaining cost of the car especially if it's in their possession

Awesome thank you ! @Kenlepp

It may be better to hire an attorney to go over the details of the lawsuit, but why they would sue someone over a car that they sold sounds fishy to me. Maybe they thought the car was fine and then it was returned with problems?
Zelda · 26-30, F
Didn’t even have the car for more than a week. Check engin came on so I returned it to be fixed and he kept giving me the runaway. Its been more than a month I couldn’t use the car. So I told him I’m not paying for a car I don’t @SW-User

@Zelda Sounds like they're trying to blame what was wrong with the car on you. And who knows when that problem would have occurred, or how long the car had actually been sitting and slowly deteriorating to the point of causing a problem as soon as you fired it up.

Fishy. Get legal protection.

Get a good attorney and shut them up, bunch of sharks.

I'm confused why the dealership is suing you...
did you get in writing what the mechanic said was the issue? Cause they should have addressed that before they sold it to you.
I'm betting the check engine light was on before they sold and all they did was connect the diagnostic tool and just clear it without addressing the actual issue..
yep, time for an attorney I'm afraid

Make sure you have clear documentation about the car and the purchase and all the times it was in the shop. Along with what was done with it. I wish you the best of luck.

You did take a loan...read d contract
Goralski · 56-60, M
@Zelda how can he have monthly payments without some kind of contract
Zelda · 26-30, F
@Goralski having a contract . And taking a loan out are two very different things . Yes, you’ll have a contract if you take out a loan but that’s not what his contract was .
Goralski · 56-60, M
@Zelda if he didn't take out a loan he wouldn't have monthly payments read d contract im sure all the penalties are described in it you can't go out and just buy a car and change your mind after a week that's not how it works

@RogueLoner Voted for BA on the account that many have probably considered similar and it feels good to vent.
