I Am Divorced

So my divorce agreement says my X is supposed to pay half of the children’s daycare fee when I work. I have a home business, therefore I need someone to care for my 2 year old during my working hours. However, he is refusing to pay because he says I don’t need to hire a daycare for me to work at home. Really?
