It's called abortion by cop. It's the only legal way to do abortion in Alabama. The police are gonna lose the case.
@apalebluedot she was not shot by police. It was an altercation with another woman. The state claims she started the fight without regard to her unborn child. She was unarmed and her shooter is not being charged because it is being called self defense.

One has to read the whole story and not just the headlines to try to understand what happened....Altercation occurred and the case was presented to a grand jury. The grand jury found that the woman doing the shooting was acting in self defense. The pregnant woman was the instigator and aggressor in an assault on the shooter. The grand jury cleared the shooter and indicted the pregnant woman for the death of the fetus.

The legal theory is similar to "felony murder". If two guys rob a store and one of them is shot and killed by the shopkeeper, the other robber can be and usually is charged with felony murder. His and the dead partner's illegal actions led to the death.

If the grand jury would have found the shooter responsible she could have been and would have been charged. As it was the only criminal activity that led to the death of the child was the mother's.

I bet they have a difficult time convicting her.
Unless she paid somebody to shoot her in the stomach, the police are seriously goofy.
My understanding of this case now is that the woman who was shot was engaged in a violent assault and her victim shot in self-defense.

The death of the child she was carrying is apparently being considered a death which occurred in the commission of a felony - her assault on the other woman.

Friends of my stepson experienced this aspect of the law twenty years ago.
They broke in the door of a farmhouse and the farmer shot at them. One boy was hit in the thumb and fell to the ground. The farmer thought he had killed the young man and went into cardiac arrest. Later that night he died and the ones who broke in to his house (a felony) were arrested on either manslaughter or murder charges, I forget which.

That is horrible.
If the woman was standing there with a baby in her arms, and initiated a conflict of any kind that resulted in the death of the baby oh, yes I would want her charged. You can no longer think for yourself once you are a parent. Particularly when your child is present, and this one was.
