Has anyone been to jail?

Recently I was in jail between the days of June 29 and July 29, 2020. A case of "wrong place, wrong time". Possession with intent to distribute meth and possession of an illegal firearm. Five people including myself were busted for a single man's crime. I didn't even do anything wrong other than be around the wrong crowd of people in a hotel room.

I just wanted to hang with my fiance. Who was hanging with a mutual friend of ours. Said mutual friend was hanging with his cousin. This cousin of his was with his girlfriend. The cousin was the one responsible and yet all five of us were arrested.

I guess this is similar to where everyone in a car gets arrested for drugs found in the car and nobody owns up to it. I guess the real question is as long as you did not admit you knew about it can they get a conviction not just an arrest.

@Subsumedpat Constructive possession is a legal fiction used to describe a situation where an individual has actual control over personal property, but not actual physical control. In other words, if the item is in your car, your room, or some area over which you have control, just not in your pocket, backpack, or in your hand. Under the laws of most states, a person with constructive possession is treated no differently than a person with actual possession. One does not even need to be in the area of the contraband at the time it is discovered for a charge to stick, they just have to have the capacity to take physical possession of it when they choose. For example, if a car is sitting parked and turned off in your driveway with no one in it, nobody has physical possession of the vehicle. But, any person with the key to the car does have constructive possession because they can take physical possession of the car (and its contents) at any time.

Most states still require the state to show that you knew, or should have known, about the drugs or gun in order to constructively possess them.

An important question is what idiot opened the door for the police.

@Subsumedpat Apparently someone reported a noise complaint and a separate individual reported drug-related activity. It was a hotel room (not my best judgment). Me and my fiance were just there chilling with friends because we didn't feel like going home right then and there, and literally if the cops would have waited twenty minutes, we mighta been gone. I've never gotten in trouble before, so i figured they might end up breaking down the door if they were given permission by the hotel owner. Three of them were arrested outside (they stupidly went outside to see why the police pulled up) and then me and my fiance answered the door, and we opened it for them. We thought that we'd get in worse trouble had we not opened the door for them.

Yes, I was inside for a short time for a silly mistake too. I wouldn't recommend it but glad you are out and you can put it behind you now!😀
