Pretty sure the Statute itself never been declared so by the Supreme Court.
Having said that, DOJ regs and Court rules make it really difficult to bring a RICO case, especially with private civil RICO cases which are the most likely to run into trouble.
And courts often overturn RICO convictions on Constitutional grounds dealing with predicate offenses, which is not the same as declaring the RICO statute unconstitutional.
