So some rapist murderer jumps out at me from behind some bushes and tries to tackle me, i then knock him down and punch him several times. and maybe i kick him while he is down. should i then be sued? i don't think so

You've heard of cognitive dissonance? That's a problem I have with situations like this. While I can understand the desire to kick the shit out of someone who attacks me, I can also understand the concept of reasonable force.
