You make the call!

Batter comes to the plate and swings at the first pitch, tips the ball straight down, the ball bounces off home plate and into the air. The catcher catches the ball, mid air, behind home plate. The batter didn't run on contact, so the catcher tags him. Is the batter out?

I don't think so because the catcher is in foul territory and the ball is "live" when fielded in foul territory only once it passes first/third base.

@ChipmunkErnie Correct. Some people think it needs to hit the ground in foul territory for it to be foul but it can bounce in fair territory, then be fielded in foul territory, in the air, before passing first or third and is considered foul.
